Beyond the Fitness respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have designated an agent to receive notifications of alleged copyright infringement occurring on our website, BeyondTheFitness.com (the “Website”).  

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this Website, please notify our designated DMCA agent in writing. Your notice must include substantially the following information:  

  1. Identification of the copyrighted work claimed to have been infringed: Please provide a specific description of the copyrighted work you claim has been infringed, including the title, author, and any registration information if available.
  2. Identification of the material that is claimed to be infringing: Please provide a specific description of the allegedly infringing material and information reasonably sufficient to permit us to locate the material on the Website (e.g., URL, page location).  
  3. Contact information: Please provide your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.  
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.  
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.  

Counter-Notification:

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our DMCA Agent:  

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.  
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.  

Repeat Infringers:

It is our policy to terminate the accounts of repeat infringers.
